I very much regret to state that my previous complaint to you with Grievance Number 2013-04-W023176 is unattended so far but strangely I got an SMS that it is solved and closed. So I rang up the contact officer Mr. Narsing Rao two days and explained to him the sorry state of sanitation in the Villa Maire Bus Stop and the need to remove all the shit and garbage and thoroughly wash the premises of the bus stop. Yet he has not acted on this till today, till now. SO IS IT QUITE CONVENIENT FOR YOU TO NOT ATTEND TO AND SOLVE THE PROBLEMS REPORTED BY THE PUBLIC BUT AFTER 3-4 DAYS JUST REPLY THAT THE PROBLEM IS SOLVED AND CLOSED? YOU SHOULD BE ASHAMED OF SUCH CONDUCT. TERROR
STRIKES AGAIN
our city of Hyderabad in bitter fury after half a
decade and, as always in such incidents, it is generally the innocent, ignorant
and lower sections of society that suffer. Long back [in the 30 September 2008
issue of our journal]
this problem of terrorism was amply covered in the editorial ‘Combating Terrorism’ when such terrorism as that indiscriminately kills
and maims non-combatant innocents on whatever ‘noble principles’ or ‘high
ideals’ advocated in its support was unequivocally condemned, and also this
analytical statement of Marx was quoted: “Terror consists mostly of useless cruelties
perpetrated by frightened people in order to reassure themselves…” Only difference here is, it
is not frightened people but scheming, vengeful fanatics who seem to have
plotted and struck. Of course it also appears to be a part of the calamitous
consequences, already warned by us, of the opportunist vote-bank policies of
the political parties – both which unjustly hanged Afzal Guru as also which try
to garner support by appeasement and even encouragement of the so-called
‘minorities’ even when those become so aggressive and cruel. However, all said
and done, we are fortunate to be in a far less violent and frightful jumble as
compared to our neighbors Pakistan or Bangladesh, and certainly so in regard to
the many Arab and other third world countries, so far as the breadth and
intensity of terror strikes are concerned but that is no cause for any
complacence. On the contrary, we should be ashamed of not being able to
maintain adequate caution and orderliness in administering our cities, even the
metro-cities, and at not being able to inculcate the needed civic sense and
discipline among the people and tidy the muddle – especially our cities are in
such a wretched, chaotic condition that it becomes so easy for any miscreant to
easily meddle with. Not only the executive and legislature, but the judiciary also
needs to share the blame – not even a single Judge seems to have visited the
terror site, or the victims in hospitals to at least assuage their hurt
feelings, nor did our superior courts seriously intervene for upholding the
causes of civic sense and order for quickly clearing up the dirty mess in our
cities at least. §§§

CONSEQUENCES
are most likely to happen after, if not sure to forthwith
follow, the tragic end of Afzal Guru. Earlier, we had pleaded
for the commutation of his death penalty not only on humanitarian grounds but
also for reasons of prudent statecraft. The manner in which his hanging was done,
especially with the 24 hours prior intimation not given, and his near and dear
not informed in advance for a last interview, strikes all the more abhorrent in
the face of the exemplary conduct of the condemned prisoner vouchsafed by the
Tihar Jail personnel and co-prisoners. As far back as in 2006 [see our editorial in LAW, 31-08-2011] we counseled moderation in regard to Afzal Guru not only per se but also in the context of our
Indian Sarabjit Singh on the death row in a Pakistani prison, suggesting that “by statesmanlike conduct … an amicable settlement be arrived at so that
ultimately the sentences on both [Afzal Guru and Sarabjit] be
commuted first and later both of them be exchanged and thus set at liberty.” We also stressed that
Afzal Guru’s sentence should be commuted as a gesture of political goodwill
towards Kashmiri Muslims who are almost in one voice demanding the same. Even
our Apex Court, strangely contrary to its own guidelines that even if
aggravating circumstances are there for imposition of death penalty, mitigating
factors must be taken into account, and the holistic consideration of ‘crime
and criminal’ in a reformative perspective should guide the courts, has set a
wrong judicial precedent by talking about the need to satisfy “the collective
conscience of the society” in this case. In Kashmir
valley we have only the peace of the graveyard now and it is anybody’s guess
when ‘the ghosts’ will spring up and death-dance in all fury there. But we
snapped the psychological binding cord with this single blunder and Yasin Malik
of JKLF protesting along with Hafiz Sayeed of LeT in Islamabad is but a pointer to this. Moreover,
if Sarabjit Singh is hanged in Pakistan
due to like pressures of their ‘collective conscience’, it can/will alienate
the Sikh psyche in India
also and we will be placed in the grave danger of yet another spurt of
Khalistani terrorism. Looking anyway, the execution is totally unwise and
fraught with deleterious effects to our country. §§§

FREEDOM
OF INTOLERANCE
appears to be available aplenty in our country, and rides
over the so-called ‘fundamental right’ of freedom of speech and expression. The
raw deal meted out to the famous actor and producer, Kamal Haasan, by intolerant
Muslim groups agitating for a ban on his film Viswaroopam and the connivance of the TN Government under
Jayalalitha with them is but one very recent instance. Not only intolerance of
various ways of life, of creeds and modes of worship, and manners of regions
and cultures is the order of the day, but even intolerance of intolerance seems
to be irrationally omniscient. True a KCR, or a Kodanda Ram or a Lagadapati or
Undavelli might have said some nasty things in their fiery mood but what of all
these nauseating FIRs etc. lodged and, gosh, directions by the lower judiciary
in various regions to register them? Don’t all these too amount to intolerance
of the very freedom of speech and expression which, as Salman Rushdie rightly
puts it, includes the freedom to offend too? Isn’t Daniel Gilbert correct in
saying: “Hateful, blasphemous, prejudiced, vulgar, rude, or ignorant remarks are
the music of a free society, and the relentless patter of idiots is how we know
we're in one. When all the words in our public conversation are fair, good and
true, it's time to make a run for the fence”? And to
quote Louis Brandeis’ wisdom: “Fear of serious injury alone
cannot justify oppression of free speech and assembly. Men feared witches and
burnt women. It is the function of speech to free men from the bondage of
irrational fears” and “The fact that speech is
likely to result in some violence or in destruction of property is not enough
to justify its suppression. There must be the probability of serious injury to
the State. Among free men, the deterrents ordinarily to be applied to crime are
education and punishment for violations of the law, not abridgements of the
rights of free speech and assembly.” To these sterling words, it is
only to be added that the laws framed must also be in promotion and not for
derogation of the freedom of speech and expression and a periodic review of any
such repressive laws, e.g. Section 153A (which even Jinnah disapproved) and the later 153B of IPC, etc. in the spirit of defence of free
speech is essential. And the superior courts should wake up and forthwith put
an end to this virtual orgy of FIRs and counter-FIRs and bans on films, etc. on
flimsy pretexts. §§§

RELIGIOUS
FUNDAMENTALISM
seems to be the real danger today confronting human
societies all over the world. Its effect in our country has always been
disastrous; here we have problem of not just one, the predominant Islamic
fundamentalism, but also the reaction to it, or what some may perceive as its
kin, Hindu fundamentalism too. And this is hideously augmented by various kinds
of other religious bigotries, caste conflicts, regional chauvinisms, etc. True,
Akbaruddin Owaisi has exceeded all bounds of prudence in making intemperate
remarks and hurling violently communal challenges during his recent speeches in
Adilabad district for which he is facing the music now, but one thing what he
said is true enough – that but for the destruction of Babri Masjid at Ayodhya,
Islamic fundamentalism and terrorism would not have become such a terrific
menace in our country. Later what occurred in Gujarat subsequent to the Godhra
train burning – itself of doubtful origins not so far properly established by
any competent, scientifically investigating body – stands as a monumental
genocidal crime committed by certain Hindu fundamentalist maniacs and crazy
mobs allegedly with all inciting and support by the then state government
headed by the now incumbent Chief Minister and its consequences to all people
of India have been so damaging and alarming with what we clearly see as a serious
spurt in Islamic terrorism. Of course, since the last two decades, especially
subsequent to the 9/11 outrage, exacerbated by the ‘counter-terrorist’
invasions and atrocities by the US, Islamic terrorism has become a big menace
to the people of the world with its horrific effects seen even in our neighboring
Islamic Republic of Pakistan. However, there are enough number of saner and
progressive elements in our society who desire religious toleration and
communal harmony; especially, Hinduism on its philosophical side generally
preaches religious tolerance and peaceful co-existence, and hence the majority
community in our country has a major responsibility to make earnest
efforts to turn the tide of such
fundamentalisms not only through strong opposition to them but also by
reforming itself to march towards the great and noble goal of vasudhaiva kutumbakam set by their
visionary seers and, hopefully, succeed. §§§
